Terms

These terms cover this website and the website services HexaNext Ltd (“HexaNext”, “we”) provides. Before we start building, we agree the details of your project in writing, and that agreement sets the scope, price and timing. If it differs from these terms, the agreement wins.

Free demos

A demo is free and you’re under no obligation to go ahead. We aim to send it within 2 working days. It’s a working preview to help you decide, not the finished site.

Prices and payment

• Prices on this site are in New Zealand dollars. [State whether they include GST once registered for GST.]
• Starter has no build fee: you pay only the monthly fee, from launch. Growth and Pro have a one-off build fee, paid in stages: 40% to start, 30% when you approve the test site, and 30% at launch. Invoices are due within [14] days.
• The monthly fee starts when your site goes live and is billed monthly in advance.

The monthly plan

• It covers hosting, your domain, security updates, backups, and the changes included in your plan each month. Unused change time doesn’t carry over.
• No lock-in: cancel any time with [one month’s] notice. We’ll hand over your content and help you move.

Ownership

• Your domain is registered in your name.
• Your content (words, photos, logo, prices) stays yours.
• Once the build is paid for, the site’s design is yours to keep. The tools and code we reuse across clients stay ours, and you can keep using them on your site for as long as you like.

Your part

You’re responsible for the content you give us being yours to use and accurate, including prices and claims about your business. We’ll check it reads well; we can’t check it’s true.

Your rights

We provide our services to businesses, so the Consumer Guarantees Act 1993 doesn’t apply, as section 43 allows. Nothing in these terms limits your rights under the Fair Trading Act 1986.
